Husband tortures physically want to file for divorce and child custody

I hv 5 year old son, m having mental & physical torture from husband, m having stage 1 thyroid cancer which is almost healed now. Does it make any difference for me to get custody of my son. In what circumstances custody of child goes to father, is it possible in my case. What if my husband refuses to divorce me and files false allegations on me to get child custody.

Yes you may file for divorce. Are you working or non working. If he agrees to divorce then you may go for mutual consent or else you will have to enter in litigation with him. You may get the child custody depending

Dear Querist, It would not matter, while deciding the divorce case and the custody of your child. Till the time your able to maintain yourself and your child, his custody will not be parted with father.
