Husband should be compelled for compromise

12-Oct-2025 (In Divorce Law)
I have been married last year in another city.. My husband and in-laws are engaged in inflicting all sorts of domestic violence against me. Three times I have to call my parents and also dialled 1090 & 112. Recently they have snatched my phone and are forcing for mutual divorce. I want that my husband & in-laws should be forced for compromise as I want to continue the marriage.

Keep digital copies of any medical report, police complaint, or audio/video evidence. If possible, email your situation to your own ID or your parents for record. Never sign any mutual divorce papers under pressure — it’s legally invalid if coerced. If you feel unsafe at night, go to the nearest police station or shelter home temporarily Would you like me to draft a sample written complaint (for police / protection officer) that clearly says you want protection and counselling, not divorce? It will help you submit it easily and start the official process.

You have a strong case under the Protection of Women from Domestic Violence Act, 2005 and relevant provisions of the Bharatiya Nyaya Sanhita (Sections 85, 86, 88 – earlier IPC 498A, 506). As you wish to continue the marriage, you can approach the Mahila Thana or Protection Officer of your district to file a domestic violence complaint seeking protection, residence, and counseling orders. You may also move an application under Section 14 of the DV Act requesting court-monitored mediation or counseling instead of divorce. Simultaneously, submit a written complaint to the SHO and SP regarding confiscation of your phone and continuous harassment to ensure your safety and communication access. Legal aid and counseling centers can assist in initiating compromise proceedings under court supervision, protecting both your rights and marital relationship.

if mutual divorce has not been finalized, you can take action against your husband and in-laws. First lodge FIR against them and also a case of DV Act. in a matrimonial dispute, a mediation will be held on and you can raise your grievance there.

I understand your situation. Since you want to continue your marriage and are facing domestic violence, you have legal remedies available: 1. You can file a Domestic Violence Petition under the PWDVA, 2005 to seek protection, residence, and maintenance. 2. Police FIR under Sections 498A/506 IPC can be lodged for cruelty and intimidation. 3. The court can direct conciliation/mediation with your husband and in-laws while ensuring your safety. 4. Mutual divorce cannot be forced without your consent.
