Husband saying he will not pay me anything in divorce. What to do?

I got separated from my husband 5 years back as he used to ill treat( physical and mental torture) me that time my baby was 3 yrs old .. even after that i tried to convince him but he didnt changed his behavior i finally decided to give him divorce i approached him but he said he will not give me even one rupee u agree on that then only i will give u divorce . his abused my parents and ran after them to beat them i warned him i will file divorce against u but before i could filethat he has sent legal notice to me putting false allegations on me and called upon me to amicably settle the matter. What to do?

First see how much final alimony he gives to you and your baby in mutual sèttelment,IF you are stisfied with that then go for such divorce otherwise first of all file 498 A complaint with concern police station .then file divorce petition and also file maintenance application .

nothing to worry. you must reply the said notice and state all your complaints, allegations, greviances. now by replying this you can straight away file police complaint against him u/s 498-A of Ipc. also you can file criminal case under domestic voilance act and ask for maintainance and other all reliefs which you and your child is in need of. there is no bar to file divorce petition simultanously and there also you can ask for maintainance and other reliefs. by opting these legal remedies you can definatly proceed with. all these proceedings can be setteled and compromised at any stage and any point of time.

Your rights to file divorce petition and claim alimony and other benefits are still intact and you should initiate divorce proceedings immediatly before he flies it. Further you can also claim under Domestic Violence act against your husband and in laws.
