Husband & mother in law abusing physically and emotionally for 12 yrs

My husband and motherinlaw have been physically and emotionally abusing me since past 12yrs. I had filed a dv case 2 yrs ago but took it back otherwise my army offr husband would have lost his job.i have 2 kids aged 10 and 7. After the dv revoked he had an affair and also verbally abuses me frequently. Now since past 2 yrs he is hiding all finance related documents.. everything with his mother. All under her lock and key. He has even bought 2 property without telling me . When i asked him he abuses and calls me names. I think he has even made his will stating all property to go to sister or mother. I am a professional but am dependent on his income now. What is the best course of action in this case? Will my kids get anything from him? What if he dies and my mil refuses to give us anything? Plz advice

Hello Madam,
You should not have kept quiet, should have filed a police complaint and also you should not have withdrawn the dv case. The only way is if you are happy in this marriage come out of that and file a divorce case . Please feel free to contact me

Madam in this case the best thing you can do is file application for maintenance for your self and your kids and also file divorce petition in court on ground of cruelty, if you don't want divorce you can file for judicial separation, further you can get all his income and property details by filing application in court in maintenance petition, the court will order to pay maintenance and even his salary and property can be attached if he fails to pay maintenance, so better file maintenance case now or he may transfer all his properties in others name in which case it would be difficult to recover.

As per your reference, you told that, he had an affair with other and verbally abuse you frequently. Here in case if your have any evidence in respect of his external affairs, you can proceed with the same., Apart from that As he was your husband it was his morel obligation on your part to look after you and the children. He could not escape from perform ethical duty as your husband.

Apart from that you have informed that you are working and also depending on his income. Here, i want to say one thing that, from earlier judgment, earning women not entitled to get maintenance and also a well educated women not entitled to get maintenance from her husband.

In your case, as you informed that you have two children. You can file a impatience case.

Better for you to have the advise from the advocate. personal hearing is required to suggest the remedy. even if he has made his will stating all property to go to sister or mother, it could be challenged in the court of law. Will will come in to force after the demise of the executor. He can also change the will under the changed circumstance.
Angry and argument are the causes for the dis-harmony in the matrimonial life. Please take care of matrimonial life in the interest of the children's future. Have hope in life. Good Luck.

Hi, these kind of family related matters needs discussion before initiating any legal action. You have right to claim of your husbands property for maintenance of you and for your kids. No information on why dv revoked. If harassment continues then you may think of filing dv again.
