Husband lying about being jobless to deny payment of maintenance

I have filed Restitution. My husband on the counselling day said he is not working which is a lie. How they will pass the 125 crpc maintenance act? Will they check his accounts. He is lying to avoid maintenance.
In your 125 maintenance case ask him to produce bank account details, his qualification certificates earlier salary slip. It shows that his capacity to earn money and body Able person. Considering his statement, qualification court will pass maintenance. If he is working and you know the details of his job then ask him to produce it return, salary slip.

If your Husband file Restitution and he was give admission that he was not working then also he was acquired education qualification and he have capasity to earn and maintened his family was his moral responsibilty. Then whether he was doing job or not his primary responsibilty to maintain his wife. He should have capasity to getting new job . If he is lying he was jobless then also he have to maintained his wife.

Dear Querist, Please file an appropriate application before the Family court for disclosing of accounts and income including income tax returns, in case he is lying, it will be clear, once court orders him to produce documents.
