Husband Leaving for Canada alone

My husband wants to settle in Canada, we applied for our (me, my husband & my daughter 8yo) PR application under Provincial Nominee Program in early 2020. The process is stalled due to covid. Since then our relationship has gone from bad to worst. He left me in NCR alone with kid during the peak of the 2nd wave after an argument, came back 3 months later when my family mediated. Though I tried all to make it work, our marriage is still in limbo, he refused to see a marriage counselor despite my repeated requests. Now he is keen on moving to Canada alone leaving both of us here. Can I stop him from doing so and make him go to a counselor to make it work again?

In case your marriage is not working out, you can file a divorce. This is a sufficient ground to seek divorce before court of law.
You can also seek maintenance from your husband as you have children.

You can file an application of section 9 of Hindu marriage act in the family court of your district where you can also move an application that your husband should not leave the country before the amicable solution. The court I will give you a opportunity for the counseling and mediation. this is the best possible way to address your problem.
