You file a civil suit that husband should not throw you out of the house. You file domestic violence to safe guard the residence and for maintenance also. Giving residence by the husband is the absolute right guaranteed in the law.

If your husband has already filed for divorce, then you have to contest your case in the family court, stating you have not given him any torture of any kind. Supposing he has just issued a notice and not filed a case yet, you can file a petition for restitution of conjugal rights, meaning, a petition asking for him to live with you again.

You can seek legal recourse through the court of law. One such option is restitution of your marital rights and followed by joint residence rights. The other options can be worked out. This will help to get your husband's vibes.

When he had two previous marriages, why did you marry him without finding out all the details about him. You must file a case for restitution of conjugal rights and try to live with him. You can also claim for maintenance if you are not working. You can also file for Domestic Violence Act. You must strongly protest in his Divorce petition and not allow him to divorce you. Also you can tell the Court about his two previous divorces. The Court will not grant him divorce so easily. If you are in Chennai and need any further assistance then you can contact me.
