Husband is Indian Citizen and wishes to divorce American citizen wife

19-Jan-2023 (In Divorce Law)
I am an NRI (Hindu) who got married to a Christian (Catholic) in Feb. 1999 at Chennai after 30 day notice under the special marriage act and is registered with the Sub Registrar Office in Santhome. She became an US citizen in 2019 and I would really appreciate it if guidance could be provided as to how a mutual consent divorce can be initiated at Chennai. What do I have to do to start the paperwork? When does she have to be present physically because of pandemic restrictions on overseas travel etc. Thank you.

The procedure is a straightforward one as long as you wish to go by mutual consent. First of all a joint petition will be filed before the family court at Chennai and after the cooling off period final order will be pronounced. Depending on her convenience the case can be initiated so that there will not be any impediments.
