HUSBAND HAS FILED FOR DIVORCE PETITION

My sister has a marriage of 4 years with one baby boy. She had separated a kitchen four months back in the same in laws home. My sister had come for a vacation during which the in laws threatened that she can not work in a separate kitchen no more and are denying entry to their home. Further they have filed for divorce petition against my sister. What can we do?

I would advise you to contest the divorce petition by engaging a lawyer with expertise and further advise you to initiate legal action against the in laws for domestic violence and seek maintenance from the husband by filing a petition under section 125 CrPC

Your sister has all legal rights. If She wants to stay in matrimonial home and doesn't want divorce she can file a case of restitution of conjugal rights. Apart from this if she has a right to go in women cell and can file case for maintenance also

Firstly What are the grounds filed for divorce by your husband that needs to be thoroughly examined and Secondly , if you are not willing for divorce and non consenting for the same . You can contest the divorce petition .
