Hi, you can file the divorce with the allegations on your husband. once you file the divorce petition, court will issue notice to your husband, if he responds and appear before the court, court will hear him or if does not appear court will make him exparte and will grant divorce to you and you can get married again.
Madam I can help you out with this we can file a case in family court man court will serve them notice if they receive the notice and do not appear court will pass expat order in your favor and divorce will be granted
Hi mam, Marriage is regarded as a sacramental in nature and not a contract. Hence, any spouse cannot re-marry unless the divorce had been granted by a competent court of law and not otherwise. Your husband can file a case of Bigamy if you marry without the knowledge and consent.Hence it is submitted that you better file a case on the ground that your husband is unheard continuously for a period of 7 years . Madam,
You need to obtain divorce in order to marry again. File a divorce petition under desertion ground in the family court jurisdiction where you are presently living and also claim permanent alimony for yourself and money for your child's maintenance, education and welfare till he attains majority as well as interim maintenance for yourself and your son till the disposal of the divorce proceedings in the same divorce petition. The challenges you may face during the divorce proceedings can only be described after fully knowing the facts pertaining to your marriage life. Contact a family court lawyer, discuss with him/her and proceed further.
