Husband and in laws repeatedly abusive, want divorce and child custody
25-Feb-2023 (In Divorce Law)
Hi, I got engaged in 2007. My husband was out of India during the courtship n was really loving and caring. We got married after 6 months. It was an arranged marriage. After 2-3 months of marriage problem started. My husbands behaviour was rude and physically abusive. In-laws made the situation worse. After 1 yr my daughter was born. By this time my relationships with in-laws & husband became very bad. My husband started hitting me really badly and I had to report in police. I dint file FIR because in police station my husband apologised. But I thought of taking divorce and lived with my parents for an year. He made no contacts and I made first email and asked for divorce. He denied Divorce. After 6 months my husband approached me and said sorry and told me he want me back. for my kids future I agreed.Life was fine for a year.He was not physically abusive. Now his behaviour is again changed.I want to divorce him but want kid custody. Plz help.
Hello app kya chahte ho only divorce ya maintenance bhi chahte ho .apka. baby kitne sal a h..or apke husband kya work krte vo divorce lena chahte h ki...nhi..appne koi complaint..bhi ki h.
Under circumstances of your matter, you may approach the court for divorce on grounds on cruelty. As far as custody of children are concerned usually the same is granted to mother, for children below 6 years, and for female child below 12 years. You also have option to file complaint against your husband under domestic violence act & under 498A IPC. Under these proceedings you may also seek mainteniance from your husband for your children and yourself. For more specific advice on your matter, you may contact me.
Mam you came file a petition of divorce in the family court.. The grounds for Divorce will be the physical abuse that you have been facing in your matrimonial life..you will get the custody of the child as he/ she is minor..
Yes you can file a Divorce Petition against husband on the ground of physical n mental cruelty by using complaint previously logdgd with police, his apologyas well as present inhuman treatment given to you.Regarding Custody you are not to worry in case the child is in your care and custody. In case he filed any Petition for taking custody you can fight for your right to retain the custody by proving that welfare of the child will be under your custodyand care and not with the father.
You can file two separate cases. One for the divorce and second for custudy of child. You can also file a case for maintainance also. If in laws or husband beat you then you can file complaint under domestic violence act.
