03-May-2023 (In Divorce Law)
I am a hindu and have applied for a mutual consent divorce. If I want to withdraw my consent should I seek a lawyer's help? How long will it take for me to withdraw the consent legally and obtain the papers from court?

The person has not mentioned about the case details. If the is filled that can be withdrawn at any time. Both parties should sign and withdrawn for genuine reason. No influence should be there. The court should order for that.

Hello Sir/Madam, Assuming Your mutual divorce petition has been registered and posted for a date after the mandatory 6 months period, you can state your intention to withdraw if you wish on the date of hearing. Once you state your intention to withdraw may be file a memo the court will be dismiss the petition as withdrawn.

Though you have filed mutual consent by presenting your person before the court, you can withdraw your consent before the matter reaches finality. You can appear on the date of hearing and inform the court regarding your consent. The Judge will record the same pass orders accordingly. In our country there is no bar for the party to appear in person and argue before any court of law. This principle is followed from Lowest court to Hon'ble Supreme Court. So hiring a service of a lawyer is as per individual requirement. The orders of the court is usually issued on request on submitting a copy application within a few days.
