For alimony you need to file a DV or a maintenance case under section 125 CrPC. And since both of the cases comes under criminal cases then it will be hard for your husband to not to come to the court. You can go upto issuing of warrants if your husband fails to appear before the court. You can also file for divorce petition under cruelty grounds against your husband. If you have already filed a case then there must be a prayer made in this regard by you. The court would consider the prayer that is sought from the court. Non-appearance of the husband makes the case weak for himself and the wife may have the remedy to get the exparte decree.

Dear client You’ll have to request the court to rule ex parte in your favour in case the divorce is filed as a contested case. In case any case of 125 is filed you may request the court for the same. Feel free to get in touch for further discussion
