How to seek divorce if husband and MIL harass me

We got married 1 year ago.it was a love marraige but with the consent of both family.my husband started harassing me after marraige. He abused my parents and said lot of bad words.his mother used to taunt me on my looks and many things.i lost control after that and started abusing him in return .he has kept all the messages in which i have abused and blackmails me..recently he had started beating me and i have photos of marks in my body parts .he choked my neck in return to which i had scratched him with my nails.he blackmails me that he will put domestic violence on me if i leave him.but the amount of bruises he gave me is more compared to what i have done.i have recording of his mother in which she is taunting about my weight. After marraige they wanted all the gifts my family gave but i denied. What should i do.i am a hindu.

Madam cast makes no difference .why are you afraid of them right now leave them go to your parents house and from there go to doctor and get medical check-up done. Then go to mahila thana and mahila ayog file FIR and complaint there . Then file case at the family court . Why afraid . They will continue this till you are there . Leave them.

What do you want now? Do you want to stay with him
you can file case under domestic violence.
If you don't want to live with him
you can file a divorce petition on ground of cruelty..
And if you want to file a criminal case against him and the family members you can file application before the women cell or Police official..

It is very bad position in india.
First if you want divorce then talk with ur husband abt ur problems and take a mutual consent divorce.
If he is not ready and do such kind of act then u go for divorce bt u must have legal ground to grant a divorce by court.
When he beat you then go for medical and contact police if you can.
If u can't do this then u can file a divorce petition against him and also file a mentenance 125 crpc case and domestic violence case against him.

Kindly, first approach a Mahila Police Station in your vicinity and file a complaint against your husband and mother-in-law.
secondly, file a case for divorce under cruelty and application for maintenance.

Hi,

This is an outright case of Domestic Violence which is happening with you. If explained correctly to the judge, she/he will understand the fact that your husband putting you through such immense cruelty and your reaction to the same is in self defence for threats to your life. You have injury marks on your body for which you have photos, it will be explained that you sought to keep the peace of the family in tact, however as the situation deteriorated it was up to you to save yourself. You can initiate complaints under the domestic violence act, Indian penal code and also seek divorce on grounds of cruelty.

I always advocate for parties to mutually work out their differences especially if there are children involved, however some situations that cannot be achieved. Do let me know if you seek any detailed clarifications.
