hello sir .... I m fron punjab... My sis got married to an NRI 3 Months ago.... Now he has stopped any talk with her from last 1 month .... He is a psyche type of person .... Even on Honeymoon ... He didnt treated her properly.... Now we want to file for divorce ex parte against him n get out of this as early as possible.. How should we proceed we want our gold back only n some compensation 3-4 Lac...

First of you can file a divorce petition under section 13 Hindhu mairage act against your husband on the ground of mental hassament and cruelty and u can manage Summons through court and claim ex parte divorce and u can also claim compensation from him by filing domestic violence case simontaneoualy and along with that u can also file dowry case against your husband and in laws to pressurise them so that they could come certain settlement and give u full maintanece/ money u deserve and your gold as well. We can file a divorce petition after one year of marriage. We can also file case for maintenance. In case he agrees for divorce then he will have to give permanent alimony also. The maintenance will be granted as per the income of the husband.

But I advise you that you can file a case seeking divorce or even the case seeking the nullity ( invalidity) of marriage against that man. The law supports you but there are procedures to be followed and therefore, the decision may take some time. I shall advise you to file the case in the court seeking divorce at the earliest.

You can file divorce. Beside that you give application to women cell for crueltyand denand.if second party will not appear in divorce case then court can pass decree exparte.so before that you have evidence regarding cruelty because your marriage is only three months old
dear we can file a case for divorce against husband. As he is residing abroad we need to get his service affected and then if he did not turn up then he would be proceeded exparte.
