How to reopen disposed Devorce case against wife
10-Oct-2023 (In Divorce Law)
Hi sir/madam,
I am Amod Gosavi from mumbai. I was filled devorce petition in year 2015 but in Feb. 2021 I was absent for 3 dates because of covid-19. my case was desposed from family court, bandra, mumbai. What can i do now. Can i reopen my case and on what basis. My financial condition is not good for paying fees of lawyer. Can i get public prosecutor for continuing my devorce case please guide me.
Well, you have to again file Divorce Petition under the concerned Sections of the Hindu Marriage Act, 1955 , if you are a Hindu and want to seek Divorce. You should have sent any Advocate to take next Date in your case rather than getting the case dismissed by personally remaining absent and not sending Advocate to appear on your behalf on such Dates when you missed to appear.
