How to proceed with divorce proceedings

I got married in may 20 2015.i stayed with my husband only 40 days n he is complaining that i didnt respect him and his elders.he want divorce der r not allowing me to the matrimonial house.im working in the same xitu where my husband stays still der r not allowing me.now he is checking with lawyers how to give divorce to me.but im not ready to give divorce frm past 11/2 yrs we r leaving separately der r not allowing me to matrimonial house.only 40 days i stayed with my husband and also der is no physical contact between us..pls advice how to step forward

He cannot get a divorce easily if you are not willing to accept it. By staying seperate for 2 years he seems to think he will get a ground for divorce. But that will not help him as you have not deserted your husband, ....

In case if you want to continue with the relationship, file a case under restitution of conjugal right and the there you can seek for reunion of your relationship.

Before he proceed, immediately you file a case. That will protect your right.

Hello,

Its better to bring an end to the relationship if there is no scope of getting together. Since your husband is not willing to continue in the wedlock better take a divorce but also ask a good maintenance and compensation as he wasted your life.

Consult and discuss more and you may file the objection of his petition and if he is contested the matter in matrimonial court, consult and discuss more and file objections against his petition, if he has already moved.

Not ready give he con't take divorce with you.., as per law.,if he ready to give you divorce.,he want to give you relief also ..and he should want to give exact reason to give the divorce..you must contact any legal counseltency as soon as possible

you need to reply to the legal notice sent to you for dishonour of cheque given by your father to your wife. if they file a case against you then you will have to defend the matter in the court.

Divorce proceedings are different then 138 matter this will not help you in helping your father, you can separately file a divorce petition against your wife.
