How to proceed with divorce if couple living in different cities

24-Aug-2023 (In Divorce Law)
1.How to run a non-mutual divorce case while both live in far-away cities? Wife stays with kids and is the sole the bread-earner. Husband stays at wife's property in home town, no regular income. History of abuse and domestic violence. Wife cannot take the trouble of running to home town many times for court hearings, leaving kids and job. She knows lawyers at home town, but not in the work-city. Husband won't show-up to court hearings at wife's work-city as he does not want to give divorce. Is there any solution? 2.Can he claim alimony?

Dear,

You can choose the jurisdiction of the family court where both of you have lived together and can file the non-mutual divorce case in the concerned family court and then seek the transfer of the petition from that place to the place where you are residing with your kids by approaching the Hon'ble High Court of that State and seek transfer of the divorce case.....
