Q: Mutual consent divorce be waste

Will mutual consent divorce be dropped if one of the parties won't appear after 6 months? Can a virtual appearance be requested?

Advocate Vikram Chandra answered
You can seek permission from the court by filing an appropriate application that one of the party he is willing to apply virtually before the court and if the court permits it’s fine however if that party is not at all willing to appear then the court will close the case as the intention of the legislature is very clear that unless both the party agree mutually and come before the court and expressed their desire for mutual consent divorce the court cannot pass any orders in the absence of one of the party

Q: Is Australian Court divorce grant considered in India

Hello All Lawyers Namaste,nI am an Australian Citizen (Indian born) and My Wife is Australian (PR) But still under Indian citizenship. we have a kid. we married in India under HMA in 2015. Due to personal and family issues, we are staying away from each other and she got our kid with herself and she is staying at her parent's place for the last 1 year. Our family and I tried our best to settle the issues with her. she is very stubborn and does not want to consider my family as our family and she does not consider or respect my aged parents and who are also kidney transplant patients. My Parents and I are emotionally traumatized and going through lots of mental trauma with her behavior and taking away our kid from us. I just had a bad face so far and realised that she is not going to change ever. without her presence, I am allowed to apply for divorce here in Australia and send her notice.if I get a divorce grant in an Australian court will the divorce be applicable in India?

Advocate Vikram Chandra answered
Better to obtain a divorce in family court in India, as you are saying that your marriage has taken place as per Hindu marriage act. Australian court judgement is not binding in India as the judgement must be under the provisions of Hindu marriage act, which the Australian court does not have power to pass a divorce decree.
