How to get divorce if marriage was done under threat

I am a 25 years old lady. i am a central gov employee. before 3-4 years I meet a person who was employed in Mumbai and told that he is highly educated and told that he is in good job but after some time when he proposed me for marriage. I did talk to my parents and they denied but he forced me and tortured me that if I don't marry him he will kill me and himself to and show me suicide note against my family he tortured me and I had to marry him forcedly after some time I came to know he is illiterate and don't do any job now I want to separate from him what should I do .

You can file a divorce petition in the court under Section 13 of the Hindu Marriage Act stating the Complete facts of the case and the way you were deceived. As your husband has allegedly married you on a false pretext you have a valid ground for filing this petition.

You can get your marriage annulled by filing a petition in the family court of your district where you are residing as it is apparent that you have agreed for the marriage based on the lies and misrepresentation of that person and your consent has been obtained by threat to kill you. In the alternative if you knew all these things prior to the solemnization of marriage then you can file a petition for divorce.

you may file petition for annulment of Marriage under sec. 12 of Hindu Marriage Act.
please tell when your marriage was solemnized.
If You have not completed 1 year of marriage you may file the same

Respected Mam,
If you could prove the things you are saying then your marriage is a voidable marriage and same may be annulled by a decree of nullity under Section 12 (1) (c) of the Hindu Marriage Act.
