How to get divorce being separated for four years

We both married in a mandir. We have a child. My wife left me four years ago taking the child with her. I asked and tried to keep the relationship but failed. When I asked her for the divorce she told we had no proof of marriage yet. How can I get rid of her now. Really I don't have any proofs of our marriage. She took child's birth certificates and other documents with her also. How can I get divorce. I have no one to support me. Please advise.

A marriage in temple following the rituals of Hindu Marriage is a marriage under the Hindu Marriage Act,1955, so until and unless divorce is granted by the competent Court of Law, that Marriage subsists. If you wish to take my Legal opinion professionally upon online payment, then can contact.

since you have a child which is the big proof you can file for divorce if you both agree for divorce then it will be mutual divorce or if one party agrees then it will be contested divorce what is your jurisdiction place...

As per your query in law rato, yes you can file a case for divorce against your wife. First speak yo your wife and then decide, if your wife is ready for mutual divorce otherwise file a contested divorce against your wife.

you can file contested divorce petition before court by providing whatever proof you have, if there is nothing then only by stating the story. this is the only way to get divorces legally. if your wife avoide to qppear before the court then court may pass exparte order in your favour. for further information contact me as and when requared.

file a suit for declaration of your marital status as single and make your wife a party to that. in case she denies the marriage then you get the status as single. if she opposes it then on that basis you can later file divorce.
