You can file Petition for Judicial separation along with application for maintenance under section 24 Of Hindu Marriage Act payable during the pendency of the proceedings convertible to order under section 25 of the same Act if you do not wish to take divorce. otherwise you can file petition for divorce along with the above applications for maintenance. Your husband will bear the expenses for children if you are not earning. If you are also earning in that case court can levy burden on both of you by proportionate to your income.
