How to convince my husband for mutual divorce

i am a married woman and my husband is not with me past 6 years. I have one son and he is not taking care of me n my son and no financial assistance from him. Now I would like to marry to look for my son's future and myself too. please advice.

Yes you may marry but before that you have take divorce from first husband .give notice and advocate will take care of your case.on grounds of 6 years separate living you may get divorce .best of luck for further info you may me

Well you seem to be in a tough soup. Apart from getting him on-board for Mutual Consent Divorce, there isn’t any ‘easy’ way to do it.

I’ll suggest you to go to a Counsellor who can talk to both of you with his/her level of expertise and experience to determine the real cause of issue. Hopefully that will clear your mind, either convince you to give your marriage another try, or at least open her eyes to the fact there no point flogging a dead horse. its depends on how you want to get separated from him, I mean, would you want to wait until he would agree to part ways mutually or would you even file case against him and take divorce from him. Easiest way out will be "mutual divorce' where in you both agree to all the terms and conditions and part ways without the court's intervention.
Hard way, Assuming that he won't come back to stay with you. File Restitution of Conjugal rights ( RCR) which says that you want your husband back to live with you. In this case, since he is not interested to stay with you he will forced to go for "mutual divorce'. However there are lot of things which goes into detail, so I would advise you to contact me for further advise

First and foremost thing is to send a legal notice to your husband seeking divorce. If you mention in the notice that you do not want any money from him or maintenance then he would readily agree for mutual divorce.

I suggest you to find trace out the address of your husband and issue a Divorce legal notice through an advocate. At the same time if he do not respond then please file a contesting divorce case. If he do not approach the court then the case will be heard Ex-Parte(Absent).

You can file divorce under the ground of desertion against your husband in family court at your place. You can also file maintenance case under Section 125 Crpc to get maintenance to you and your son until the disposal of the case and you can claim alimony in your divorce case.
