16-Oct-2023 (In Divorce Law)
Hi.My father took ex-parte divorce from my mother after retirement. He is retired govt. servant earning more than 1Lakh as pension. We filed RTI with his office, but they refused to share pension details citing section 8(1)(j).How we will prove his salary to get maintenance/alimony?He might show false medical bills, and we know that he has commuted 40% of his pension. Please guide on how to get a proper maintenance amount.

Hi
Your mother can appeal against the ex-parte divorce and have it set it aside citing non receipt of summons, not able to attend courts on health issues etc.
Also, in maintenance cases, the husband is duty bound to produce the remuneration slip( salary/pension) in the court or you can ask the court to issue summons to the officer in charge of paying salary/pension to your dad. The officer in charge of paying salary/pension has to compulsorily provide the pension details of your dad to the court.
