How to apply for ex parte divorce against husband

Dear Sir, Can I apply for ex parte divorce while don't having any prove and evidence of domestic violence and Adultery of husband.

Since you have not disclosed you religion , i will presume you as a Hindu. There are other grounds too available under Hindu marriage act for divorce. Ex-parte order is only possible if your husband - 1. Refuse to accept service of summon . 2. Did not come to court after receiving the summon. Otherwise you can approach court for any other ground.

hello mam hru. as your question is concern about exparty divorce gainst husband can be filled but there are chances tht it may convert in contested divorce instead of expaety. yes it is possible to get exparty in the condition tht upu may get grant if exparty divorce with the help of an advocate then it is higher chances of getting exparty divoce from husband . in ur case is concern tht you do not have any evidences of domestic voilnace as well as of adultry in tht case ground for seperation need to be created so tht it may support your teason to get sepeated from husband and court get agreed on it

Hello exparte orders are passed only when the party even after due service do not appear in the court. There is no other way for the same and for getting a divorce decree on the basis of domestic violence and adultery there is the need of atleast some evidence in your favor.
