send a notice to wife/husband, then apply for divorce through a petition in court about child maintance if child is above 5 years and you are husband then you can file a petition for child handover to the court,but most of the time 98 percent of the child is handover to wife unless wife is mentally retard or economically and financially very weak.

Are you Hindu or Christian or Muslim. of Hindu means there was 2types of divorce 1. Mutual divorce it means you and ur partner has to come and agree for divorce 2. Contested divorce one person willing other person not willing If mutual divorce means you need to file petition under section 13-B of Hindu marriage act. If contested divorce means you need to file petition under 13(1) sub clause of Hindu Marriage Act Or if Christian means Christian act or if Muslim means Muslim act will apply
