How should I get mutually divorced husband is not ready to give money

Hello sir/mam , I got married in 2014 but from 2015 we r living separately . And I filed for maintainance case in 2016 but in 18 I got a job as a trainee in which I get 10000rs per month so can I get maintainance bcz 10000 is nt sufficient in city like Mumbai n his salary is 1,20,000 per month n no one is dependent on him and he is not ready mutual divorce also by giving some amount . So what shud I do in this case please please help me in this with proper solution bcz 2yrs gone n no yet no result of my n be he is serching for a bride so please tell me what to do ?? Bcz that person totally ruined my life n ,he disturbs me mentally Bry badly , my parents are always in tension . So I want Justice asap so please help me .please . Thanku

Your income is not permanent therefore that income cannot be considered.It is personal liability of husband to maintain his wife.If your husband is not ready for giving maintenance if court ordered for payment .Then you can recover from his salary.Or puts encumbrance on his property for not paid maintainence amount.If he had not taken Divorce then he cannot marry again with another lady.Because second marriage if first wife is alive that can be treated as criminal offence under under section 494 of IPC.Therefore getting divorce is his need.

Dear queriest, as per your query you have mentioned about the fact that your husband and you are not staying together since 2015, and you have filed for maintenance in the year 2016, here is maintenance is going on and you have not filed for divorce then the situation will not changez you have to either file for divorce and ask for permanent alimony. and finish of the issue permanently if you are willing to. for more details please feel free to call me for the same.
