District court fixed permanent maintenance order and recovery warrant is filed.husband files recall how much time recall will take 3-4 months or more.while recall is going on judge will order husband to give monthly maintenance fixed or not. Without payment he will drag recall case.Is it possible.Already he is not paying anything since 2 yrs.how much more he can delay.Mediation after recall. If wife refuse mediation he will start paying.Ater recovery warrant only he will pay.6 and12 yrs involved
Once the District Court has fixed permanent maintenance and a recovery warrant has been issued, the husband is legally bound to comply with the order. Merely filing a recall application does not automatically stay the maintenance order or recovery proceedings. Unless the court specifically grants a stay, the husband remains liable to pay the monthly maintenance as fixed.
A recall application may take 3–6 months or longer, depending on court pendency, but delay tactics are not legally protected. During the pendency of the recall, the wife can insist on continued payment and press for execution of recovery warrant, including attachment of salary/property or arrest under execution provisions.
If the husband has not paid maintenance for 2 years, arrears can be recovered with interest and coercive steps. Courts take a serious view of wilful default, especially where minor children (6 and 12 years) are involved. Non-payment despite capacity can even lead to civil detention.
Mediation does not suspend maintenance. The wife has the legal right to refuse mediation, and refusal cannot be used as a ground to stop maintenance payments. Payment only after recovery warrant does not absolve past defaults.
