Husband is working in Indian army and wife is pursuing phd, husband is not fulfiling his duties infact abusing verbally and physically, earlier fir was registered but taken back as he promiosed to improve but he remains the same. we are notr living together and he is not supporting me financially, i have been married for 3 years, and recently i sent the legal notice but he denied that he doesn't receive anything. I want divorce in phone call he asked for mutual divorce but later he is denying,
If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. Ma'am, it is quite apparent that he is not interested in mutual divorce. I see that you have mentioned that he's not maintaining you. There are several ways you can make him maintain you, but I would suggest you file a petition under Sec. 12, PWDV Act, 2005, wherein, you can get expeditious trial and get your maintenance granted in a very short span of time and simultaneously you should file a contested divorce case against him based on the ground of physical and financial cruelty.
