In India, the number of court hearings in a divorce case depends largely on whether it is filed under mutual consent or is contested:

  • Mutual Consent Divorce:
Typically involves at least two hearings. The first hearing records the joint petition, and after a mandatory cooling-off period (usually six months, though it can sometimes be waived), the second hearing finalizes the divorce decree. These cases are usually completed within 6-12 months.

  • Contested Divorce:
There is no fixed number of hearings, as these cases involve presenting evidence, cross-examination, and arguments. The timeline can vary based on factors like case complexity, availability of witnesses, and the court's schedule.

    • Average duration: Often 3-5 years, though some cases conclude in 1-2 years if uncontested issues arise or if parties settle midway.

    • Number of hearings: Can range from a handful to dozens, depending on how quickly proceedings move forward.

it depends on court working ,there is no fix dates ,also depending on the nature and allegations made in the court....STEP 1: Filing of petition by the husband or wife. STEP 2: Court issues summons and seeks reply from the other spouse. STEP 3: Court may suggest reconciliation. STEP 4: Examination and cross-examination of witnesses and evidence. STEP 5: Counsels for both parties present final arguments. STEP 6: Decree of divorce passed by the court.
