Maintenance cases are decided on evidence, financial capacity, employability, conduct of parties and genuine dependency — not merely on gender. If your spouse was recently earning approximately ₹6 lakhs per month abroad, is highly qualified, healthy and employable, those facts are legally significant and can materially affect interim and permanent maintenance claims. Hyderabad/ Telangana courts are increasingly scrutinising: • Actual earning capacity • Deliberate unemployment or voluntary resignation • Educational qualifications and prior income history • Duration of marriage • Absence of children/dependency • Suppression of income or assets A spouse who is well-qualified and previously earning substantial income may not automatically be entitled to heavy maintenance merely because she is temporarily unemployed. However, much depends upon: • Reason for resignation • Present financial status • Standard of living during marriage • Your comparative income and assets • Evidence placed before Court You should immediately secure: • Employment records • Salary slips / tax documents • Foreign employment proof • Bank statements • LinkedIn/profile/employment history • Any evidence showing voluntary resignation or earning capacity Avoid overconfidence or internet assumptions. Courts decide case-specific facts. With proper financial evidence and effective contest, you may have a strong defence against excessive or unjustified maintenance claims.

There is no legal principle that maintenance claims are decided differently in North India and South India. Courts across India apply the same statutory provisions and are guided by the same Supreme Court precedents. Further, there is no straight-jacket formula for granting or denying maintenance. The court will examine all relevant facts, including the wife's qualifications, past employment, earning capacity, present income, assets, standard of living, and importantly, the reasons why she stopped working. If she was earning substantially before filing the case, that fact can certainly be brought on record. However, the outcome will depend on the evidence and circumstances of the particular case rather than any regional trend.
