How final settlement calculated?

My wife filed sec9, I filed sec13 1 ia. Court counseling failed. I am not ready to continue with her. No kids. She was working women before separation and earned upto lakh per month. I have private job with salary 1.5 lakhs per month. I have no properties on my name but my parents have properties. still she get maintenance and share on my parents properties? How final settlement or alimony calculated by the court?

1. your wife can claim on your property and not on your parents property. 2. alimony is calculated on the status of parties and income and expenditure of the parties. 3. your wife has sufficient income so the court considers her income also.

Hello sir, your wife cannot ask your parents property for maintaince in divorce case. But you have good salary. Court can pass order 1/3rd of your salary. But if you prove she is earning one lakh per month then court will reduce permanent alimony. If you need further advice please contact me.
