How can I make them respond to my legal doc, take action against them?

Me and my husband holds Philippines passport. My in-laws hold Indian passport. Family is based in Manila. We got married in Pune in 2018 but registered it in Manila. Now, I have filed for divorce. We have sent them legal notice, summon and FIR in the span of 3 months. They haven’t responded to anything. How should I proceed with this divorce? What action can I take for them to come down to India or at least end this marriage?

Hi Good Afternoon, As you mention that you were married in India As per the Indian law. and if you file Divorce in India then Indian court have a right to decide the Divorce Petition. now you said that you file fir and you sending the summons As well As notice. then first thing proceed ex parte in the Divorce Petition and go with this way. secondly request to issue non bailable warrant against your husband in the court. for more details and querries then contact us and visit our website.

Well, if the Indian Court can send summons to your Husband, then, he has to appear. So, you have to convince the concerned Indian Family Court to serve him a Summons in a Divorce case filed by you to seek Divorce from him in India. You can merely seek Divorce from him in India, if two of you have got legally married in India as per the law of India.

If they don't come then you can still get exparte divorce. It may take 2 - 3 years for exparte divorce. if you have filed for divorce in India then no use unless you have shifted back here and have valid indian documents. otherwise your divorce can only happen in Manila
