How can i file divorce without any ground for filing that

18-Sep-2023 (In Divorce Law)
I want to file a divorce with my husband. We don't have any big issues but somehow due to our personal mismatch, there is no compatibility, it is difficult to stay together. Is it possible to get divorce without any strong reason. We are Hindus married for almost 5.5 years. Please mention the procedure also for filling a divorce case.

Want to understand both husband and wife want to get separated and is it agreed between you both to get divorce? ... If yes than you can file mutual consent petition wherein you both get divorce within 6 months ... Kindly contact me so that I can help you out in the procedure

You can file a joint petition for Mutual Consent. Section 13 (B) of the Hindu Marriage Act provides for Divorce by Mutual Consent. Since you have been married for more than 5.5 years, if you have been living apart for more than 12 months, you can file a joint petition. The procedure is simple: Once you file the case, you have to wait for 6-months. This is a mandatory period and can only be relaxed if there are compelling reasons why you want it to be done earlier. After 6-months, parties have to be present for a court hearing and once the mutual issues are settled (joint property, child custody, exchange of items etc.) Divorce may be granted by the Court/ Judge. In total, you will need to be present in Court for 3-5 days and it can take upto 6-7 months for the proceedings to end. My advice is limited to the facts stated - please contact me for more information.
