How can I claim for maintenance from my separated husband

Me and my Son are living seperate from my husband, i want some financial support from my husband please suggest me

You can file a petition for maintenance against your husband before the court of Judicial Magistrate/ Family Court under section 125 Cr.P.C for granting maintenance on behalf of you and your son within the jurisdiction of your area

If your son is minor then you both can claim maintenance from your husband even you cam claim past maintenance under hindu adoption and maintenance act you cam also claim right of residence in the property of your husband or in the alternative court can order your husband to oay reny under protection of a women fro domestic violence act

There are number of privision in the different acts for claiming maintenance from spouse. You can file a petition under section 125 Cr.P.C, under domestic violence act or if you are Hindu under section 18 and 20 of Hindu adoption and maintenance act.

you can file application under section 125 pf code of criminal procedure 1973 for yourself and for your son if he is minor, against your husband before the family/judicial magistrate's court in the city where you are living. you also claim any other financial assistances from your father by filing comppaint under provisions of Domestic violence Act. you can also claim maintenance under provisions of hindu adoption and maintenance Act 1956 if you are relatrd to hindu, sikh jain or budhism.
