Answer to this is always in the Judgment and order of the proceedings. It must have been clearly mentioned about the liabilities and responsibilities in the Divorce case. It also consists part of performances / compliance on every parties too.

You are fully responsible for the debt from a lender's perspective if a loan is in your name, whether as the main applicant or a co-applicant. If your former spouse, who has agreed to handle the debt, defaults in future, you will be responsible for the payments and late fees, etc. In simple terms, the loan contract does not get affected by the terms & conditions of the divorce agreement. Any change of name, address or even notifying the lenders about the divorce cannot make you escape your debt responsibility.

Dear queriest, as per your query you have mentioned home loan liabilities, regarding this I would like to suggest that, when you have applied for divorce, you are supposed to make a point to all specific needs and liabilities before the Hon'ble Court so that the question of any liabilities does not remain behind and un-resolved, if the same is been noticed or pointed out before the Hon'ble Court the Court will decide the same and henceforth.

We advice take possession first.In joint home loan make application before court with your ground of financial capacity ..in case of default present application with account..Inform or send copy to bank too.

No any liabilities for joint home loan after divorce .beacuse divorce is permanent dissolution of marriage .then after divorce no any liabilities are created to each other.if husband and wife has taken divorce then no any liabilities for for joint home loan they are separated from each other
