17-May-2023 (In Divorce Law)
Got mutual consent divorce from Supreme Court under Article 142 in March 2023 and paid X amount of 1 time alimony on the condition that wife will need it to maintain herself after divorce without second marriage. Now, ex wife got married in May. What can I do to file appeal and get back the alimony amount as she got married and her new husband will maintain her. What legal actions can I take?

Any amount paid in consent decree can not be recovered unless the same has been paid in some fraud or coercion. In your case the said amount has been paid for mutual divorce. However if the order of the Hon’ble Supreme Court has imposed any such condition for remarry, then the order needs to be perused. Please feel free to contact.
