Hi law expert's, I would like to know if a wife registered 498a & DP 3&4 complaint on husband and his family, and case is in HBC stage in the court, and also filed DV case along with the 498a case, now she has applied for divorce case in family court, is it possible to grant divorce before judgment / result of 498a,DP 3&4, DV case?and if husband doesn't want to give divorce to his wife and wants to continue 498a DP 3&4, DV Case wants to prove his & family innocence in the above case,is it possible to continue the case if divorce is granted?or else how can he prove his innocence to the court?Please advise on this matter. Thanks in advance.

Dear Sir, Both cases are different cases. DV and 498A filed by police are criminal cases. Divorce is civil case. Even if divorce is granted you can continue with other cases. You may prove your innocence by filing discharge application under section 239 of CrPC and if not discharged you can approach High Court.
