Hi I got married to a Sikh Boy. Within 15 days of marriage we got to know he has an advanced eye disease keratoconus and both his eyes require corneal transplant and disease is genetic in nature. And the boy and his family already knew these facts and it was hidden from us. Boy's family is ready for mutual consent divorce. I am 31 yrs of age should I go for annulment or Mutual consent divorce which is less time taking.

I would suggest you to go for a mutual consent divorce as per section 13 (1)b of the Hindu marriage Act. Section 11 of the HMA talks about annulment but it will take more time and you need to prove misrepresentation by your spouse.

1. If boy is good in nature & his eyes can b treated permanently then you must not go for divorce. 2. If you have decided that you have to go for divorce then mutual divorce is the best way and you can make a settlement deed for everything! Be in touch
