Now he came back resigned his job because of health issue I didn't go asked him to wait till I recover he was happy and often visited me then stopped coming but after two months send divorce petition stating mental cruelty and desertion. Pleaded him to take back but blocked all contacts adamant on divorce. My FIL is verbally abusive and harasess mentally and also ask for dowry and properties. We have a child. I want to stay with him but now he is ignoring us. I don't want divorce. What should I do? I have filed for maintenance only.
you may file a petition seeking orders for restitution of conjugal rights before the family court concerned against your husband with the pleadings that you and your child are desirous to live with him as his wife and child
Now that divorce petition has been filed you need to contest on merits. At the same time keep opportunities for settlement open. You may file a petition seeking restoration of conjugal rights as well seek maintenance pendente lite (if you have no independent income sufficient for your means ). However, avoid any retaliatory steps, such as exaggerated allegations of domestic violence and dowry harassment.
