Hello My name is Ashwani Mishra and I hot married in the year 2009. I filed for a divorce case in June 2018 on the grounds of mental cruelity and desertion. My wife's lawyer appeared only once so far and the court has decided to strike off their defence. My in-laws have started to harras me by filing fake police cases. Recently they filed a case under section 308, 323, 498A , 504, 506 and 507. They have been avoiding to appear for the divorce case hearing. Could you please let me what are my rights in this case and what preventive measures can I take to avoid any future harrasment efforts by them? Also, would it be the right step for me to inform the court about these fake cases?

Now since the Honourble Court had struck off the defence of your spouse in the divorce petition you will be able to get an exparte divorce decree. However so far as criminal case filed by your spouse is concerned, the details would be required to advise further.

you should Inform the court about all the cases filed against you by your wife and in-laws. this is cruelty if they are filing fake cases and appearing in them and not appearing in divorce case can easily prove their conduct before the court.
