Hello, me and my husband don't live together as he left me with my kids few months back. How to claim child maintenance without divorce as I don't want to get separated but don't want to suffer financially too because of his family who brainwashed him. Ready to be with him if he understand that his wife and kids are his real family now after marriage not just parents and sister.I am a working girl. I can give divorce but still unable to decide , hoping for some miracle to happen that he will be back.

okay I understand your questions so now you want maintainance from your husband to kids right. so what your husband working you have a proof for salary sleep and how much salary he got everything will court ask but it is possible to file a maintainance case from court 125:crpc is applied so do you need any legal help contact me thank you

You can claim maintenance for kids without seeking or filing fordivorce from your husband by filing under section 125 CRPC and again under family law . you can also file for asking the courts direction to him to live with you. (you being a working girl will only come in your way of seeking maintenance for yourself.)
