Hello, A couple is married as a hindu rituals, but never registered in court. They have only lived together for 1 day. Due to conflict, now they live separately. It has been 2.5 year now since separation. Can that marriage be canceled or voided? Is that marriage still active? Can one of them move forward and marry again (to 3rd person)? How does the court looks at? What steps would clear and how long could it take? ?

Dear queriest, as per your query you have mentioned about the fact that your marriage has been past 2.5 years and now you want to get divorced, yes you can file for divorce even though it is not registered and also can marry other person once decree of divorce is passed

Registration of marriage is not compulsory.If you got married according to Hindu rituals then you may file divorce petition in Court by mutual consent or on the ground of desertion. You must follow legal procedure by which your legal relation with your wife can be ended.
