Grounds for Divorce - Mental Cruelty.

28-Dec-2023 (In Divorce Law)
Does screaming & crying loudly be considered as mental cruelty? Does court grant divorce on this grounds alone? Or can court order the couple for cohabitation? What happens if the petitioner does not agree for cohabitation?

Not if you did so a couple of times even. It can be justified as response to provocation: I believe i had once replied to perhaps a similar post a few days back. To be considered as an act of mental cruelty in Court it should be so proved by the other side and should be shown to be of something regular in occorance:

cohabitation is living together or having sex without marriage. if you want to file a divorce then you should be legally married couple and you can file for divorce on various grounds or few grounds also. if it is an live in relation then you can file for domestic violence case and claim form maintainence. If you want to prove others cohabitation or your spouse's then you should have a solid evidence it can be a ground for divorce. Even otherwise adultry is unconstituted
