Foreign Inter relegion marriage between a hindu and Christian

we are hindus and my brother married a christian woman in Russia. Is the marriage valid in india? What is the procedure for divorce?

hello client as you are saying your brother have gone fir marraige with russian chirstian girl a yes this marriage is valid in india. as you are asking for divorce procese so for tht we nees to knw tht girl is willing for divorce or not they are living in india or not have they cohabited together or not you have to mention these facts then only divorce process can be explained as per the law.

There are many points that need to be clarified before answering your question as whether the marriage was solemnised in Russia or India and whether the marriage was solemnised as per Hindu rights and rituals or your brother changed his religion before marriage. If the parties had done their marriage marriage through the special marriage act then it will be valid. And as far as the divorce is concerned it will be governed by section 27 of the special marriage act. There are many grounds on which divorce can be granted in the section. Dear client The process of divorce would depend upon the place of jurisdiction wherein the parties submitted to. In case of Russian jurisdiction, the foreign decree would have to be executed here in India

Yes marriage done anywhere in the world is valid ! The question is did your brother get that marriage registered in India ? Then divorce can only happen via special marriage act if her wife hasn’t converted to Hindu religion. If she has converted then as per HMA. If marriage is registered then as per SMA. But whether that divorce is applicable in Russia or not that depends on Russian laws ! B in touch
