‘For Steps’ in divorce case

04-Sep-2024 (In Divorce Law)
I’m 31yrs old Hindu male, contested for divorce. And my shifted to abroad. And I don’t have any clue for her address. On the recent hearing, the reply from judge is “Petition filed U/or 5 Rule 25 CPC returned with objections call on 18-09-2024”. I understand that notice will be served by electronic mode like email ID, WhatsApp etc. I’m looking for a second opinion on this. Thanks.

Nowadays the delivery of summons can be done through email and whatsapp also. And as far your application under order 5 rule 25 is concerned it's advisable to clear all the objections and physical summons can also be issued by the ministry of external affairs.

The query raised by you is not clear. I presume that the judge has asked for the fresh pf to be filed for the concerned person and the same may be served through electronic mode also. In that case you will have to send the complete petition either by WhatsApp or email or any other form.

you can ask the judge to proceed with the matter ex parte since the wife isn't coming to attend and you don't know her correct address. email, whatsapp, are other modes to affect delivery of summons which have been duly recognised by the Supreme Court

You may seek a detailed legal opinion from an Advocate having expertise in family matters. Do Brief him and Seek a considered opinion. If you Dont have her address do serve her on the last known address. Else it will be serves through publication

See in India there is no concept of No Fault Divorce, you would not be getting divorce ex-parte, either you have to get it mutually or file the divorce petition under section 13 of HMA, see if she is not responding to your petition, file petion under section 10 of HMA for judicial separation
