Filing Of Divorce On Account Of Admission Of Wife On Whatsapp

If a wife through whatsapp , massage her husband that she had an affair with someone and had physical relation also ,can this massage be shown in the court as proof of adultery and can divorce be filed on this ground.and if divorce is granted is there any alimony be given to wife in this case.further it is to be mentioned that the wife is in goverment service earning about 60000 rs per month.

I have perused the contents of your query and would advise you as follows : (1) Yes the admission by your spouse on watsapp would be admissible in evidence and divorce petition on the ground of adultary can be filed and granted. The message if coupled with other proofs can be used for filing for divorce on grounds of adultry and cruelty under section 13 of the Hindu Marriage Act.
In case the wife files an application for grant of maintenance, interim maintenance can be granted if the wife is unable to maintain herself, on the basis of income of the husband. While granting maintenance and alimony, the court will consider the income, expenditures, assets and liabilities of both parties.

you want to know about watsup massage be shown in the court for the your defence .yes you file the c.d.alongwith 65 b certificate in evidence act and grant the divorce from the court .
