Hi, it depends on which jurisdiction you wish to file. We take a day to file the petition subject to receipt of all documents, and thereafter registry takes a week to list it in court. The first date of listing is usually admission and counselling, post which court gives a 6month cooling off period.

Mutual divorce petition first needs to be drafted based on the settlement between the parties and also as per the legal requirement of separation of 1 year. Once it is filed can be listed in a week or so after passing the scrutiny. Parties presence is required on the date of first motion and second motion only and not in filing of the case. For further query feel free to connect. Thanks

the petition is considered immediately after filing. after considering the position of parties court passes first motion, after which parties are given a 6 month cooling off period during which they can reconsider their decision. after 6 months court will grant divorce if both parties do not reconcile.

Hi there, for filing a Mutual divorce petition it takes a general 2-3 days for approval from the court registry then the matter is listed in the concerned judge's court. So from filing till first date it's done within 5 working days. Post that if judge is satisfied the first motion is accepted on the first date itself (the conditions should be decided on prior basis to avoid meditation proceedings). If the conditions are accepted by the both parties and the judge is convinced then a date is given for the second motion (about 12months gap) and if still after the first motion no cohabitation is possible then the period of 12 months can be waived off by filing an application for the same. In total it will take max 3-5 months for your divorce to be granted. If you have any other questions feel free to contact me.
