filing for maintenance from husband

12-Nov-2025 (In Divorce Law)
“Sir, I want to file a Section 125 Cr.P.C. maintenance case. I’m divorced by mutual consent but no alimony was given. My husband works in the police department and earns around ₹45,000–₹50,000 per month. I have no income and my 11-year-old son lives with me. I want the court to fix maintenance as 40–50% of his net salary, or at least ₹25,000 per month, with an automatic increase as his salary increases — say 10% every 3 years or along with pay revisions and interem relief

Under Section 125 Cr.P.C., a divorced woman who has not been granted permanent alimony during mutual consent proceedings is entitled to claim maintenance if she lacks independent income for her sustenance. The obligation of the husband to maintain his wife and minor child continues even after divorce if the wife remains unmarried and without sufficient means. Considering the respondent’s stable government employment and monthly income of ₹45,000–₹50,000, the Hon’ble Court may reasonably direct him to pay 40–50% of his net salary or ₹25,000 per month, whichever is higher, towards your and your child’s maintenance, along with interim relief pending disposal of the petition. You may also request periodic enhancement linked with salary revision or inflation.
