Dear Madam, You have to file two cases. One for Divorce with huge alimony if interested or just ask for his consent for filing mutual divorce. You may have to file permanent child custody case with visitation rights or enter into compromise giving permanent custody to the husband and retain your right for visitation.

if you and your husband have agreed on an arrangement about your son staying with him and visiting you on holidays for vacation you can mention this and file a mutual consent divorce, if your husband agrees for such a mutual consent divorce
